Federal Circuit Court Scraps Trump Administration’s Power Plant Rule

The DC Court of Appeals recently scrapped the Trump administration’s Affordable Clean Energy rule that eased limits on carbon dioxide emissions from coal- and natural-gas-fired power plants, effectively reviving the Obama administration’s tougher Clean Power Plan.

Bracewell’s Jeff Holmstead told The Washington Post that the “ruling is a big loss for the Trump administration, but it’s probably not the last word on the matter.” Holmstead also noted that the Supreme Court before Trump “stopped the Clean Power Plan from coming into effect” while litigation proceeded. “The current Supreme Court is likely to be even more skeptical,” he said.
