Bracewell & Giuliani LLP’s IP litigation group obtained affirmance in the United States Court of Appeals for the Federal Circuit of the summary judgment won on behalf of Overstock.com, Inc., a leading e-retailer.
H-W Technology claimed that Overstock infringed its patent, U.S. Patent No. 7,525,955 “the ’955 patent,” titled Internet protocol (IP) phone with search and advertising capability. The United States District Court for the Northern District of Texas granted summary judgment in favor of Overstock invalidating the two asserted patent claims. The Federal Circuit affirmed the judgment for Overstock holding that one of the asserted claims was invalid and that the other was unenforceable. The Federal Circuit also upheld the District Court’s claim construction Order.
