State Courts Split Over Workers’ Medical Pot Reimbursements

Bracewell’s Bob Nichols spoke to Law360’s Sam Reisman regarding recent cases in state courts regarding injured employees eligibility for reimbursement for medical marijuana. 

He said that while courses are increasingly sympathetic to extending employee protections to medical marijuana users, this transition will create ongoing complications for employers, especially companies with employees in multiple states.

“This is a godawful mess for employers, and it’s going to be for years to come, because the ultimate solution is federal legalization,” Nichols said. “There’s no indication or expectation that this mess will end anytime soon because it will take federal legalization for that to happen.”
