Personal Injury And Med Mal Cases To Watch In 2019

Peter Kang of Law360 recently wrote about cases that could shape the future of personal injury and medical malpractice law in 2019. Peter cited a case being argued by Warren Harris.

In the case of Windrum v. Kareh, the Supreme Court of Texas is reviewing a medical malpractice suit accusing Dr. Victor Kareh of failing to diagnose and properly treat Lancer Windrum’s brain condition. The case should determine whether a lower appeals court misapplied the “conclusory-opinion standard” for expert witness testimony.

Harris argued on behalf of the Windrum family that the “expert can testify based on his experience, based on medical records, tests, testimony of other doctors. And that’s what was done in this case.”
