
About Richard
During his career, Richard Danysh has tried approximately 40 civil jury trials to verdict and has been recognized for his skill by his peers with election as a fellow in the American College of Trial Lawyers. He has also initiated, prepared and participated in numerous “mock trials” in cases involving claims for substantial damages. His work has encompassed all aspects of state and federal trials, arbitration and forms of alternative dispute resolution.
His cases have run a wide spectrum including breach of contract, fraud, tortious interference, personal injury defense, wrongful death, premises liability, property damage, lender liability and related disputes. In addition, he has experience in environmental tort litigation. Richard’s clients come from a variety of industries including brewing, sports, energy, financial services and manufacturing.

Bexar County, Texas — cross-action by Bexar County against a surety, NGM Insurance Company, to a performance bond for the performance of an IT contract for the acquisition and implementation of an integrated justice system which resulted in a $2.9 million settlement
Tim Duncan — lead counsel in actions prosecuted on behalf of former NBA player for the San Antonio Spurs against his former financial advisor, Charles Banks, for breach of fiduciary relationship, fraud, securities violations and related causes of action
Valero Energy Corporation — lead counsel in a declaratory judgment action for “additional insured” coverage and indemnity against seven insurers and six contractors to recovers sums paid to settle wrongful death/personal injury action brought against Valero and others after an explosion and flash fire at a Memphis refinery
CPS Energy — defense and prosecution of cross-action in federal district court for breach of contract for the construction of high energy transmission lines after the collapse of a lattice tower and transmission lines upon rush hour traffic in Northwest San Antonio
Anheuser-Busch Inc. — successful prosecution of motion for summary judgment for defense fees and costs, all settlement payments or judgment amounts incurred in wrongful death actions filed in Texas and Missouri
Sea World Texas Inc., Sea World California, a division of Sea World Inc. and Busch Entertainment Corporation — successful prosecution of breach of contract action and defense of breach of contract, fraud, tortious interference, negligent misrepresentation claims arising out of multi state relationship with vendor in recreation/entertainment industry (three-week trial in California)
Warm Springs Rehabilitation Foundation Inc. — successful arbitration of disputes arising from acquisition of rehabilitation entity and facility
Warm Springs Rehabilitation Foundation Inc. — breach of contract action arising from the operation and winding-down of the joint ownership of a rehabilitation facility
Warm Springs Rehabilitation Foundation Inc. d/b/a Warm Springs Rehabilitation Hospital-San Antonio, Warm Springs Rehabilitation Hospital-Gonzales, and Warm Springs Rehabilitation Hospital-Victoria — breach of contract claim by health care supplier of hyperbaric service to rehabilitation facility after changes in Medicare reimbursement industry

City of Laredo, Texas — successful appeal of $1 million verdict which was reversed and rendered (did not try the cases that resulted in the verdict)
Bexar County Hospital District, Honeywell Inc. and Honeywell Medical Electronics Division a/k/a Electronics for Medicine — defense of products liability claim arising from a patient in a permanent vegetative state after claimed failure of heart monitor. Defense included a two-day mock trial
Southern Pacific Transportation Co. — successful defense of FELA claims
City of San Antonio, Texas — successful defense of claim arising out of destruction by fire of residence due to an electrical fire
