Vaccine Mandates: How Sincere is a ‘Sincerely Held Belief’?

Bracewell’s Bob Nichols recently discussed with The Christian Science Monitor the growing number of requests from employees seeking COVID-19 vaccination exemptions based on their religious objections.

Nichols said that employers may ask employees to explain their religious beliefs in writing to gain exemptions.

“You could ask them to write you an attestation or an explanation that they have this sincerely held religious belief – and that’s what our clients can and routinely do, and I think it’s appropriate,” says Nichols, who has been advising clients throughout the pandemic. “They can say, ‘OK, write me a statement attesting to that belief or practice you say you have, and to the best you can, please explain that belief to me and sign it.’”
