Bracewell’s David Shargel told The National Law Journal that in SEC Chair Gary Gensler’s tenure, in which he brought cases against heavy hitters in the crypto industry and set precedents in SEC proceedings and in state and federal courts, could still have an impact well into the second Trump administration.

“The SEC recognizes that the plaintiff’s bar is a complement to its enforcement authority, and it could mean that a decrease in the regulatory enforcement leads to an uptick in private litigation to fill that void,” Shargel said. “With a likely Republican-controlled Congress, the door is open for Trump to push through new rules and regulations that provide more clarity than the body of case law so far.”
