Law360 quoted Bracewell’s Rachel Goldman on one of the top cases the US Supreme Court will hear during the October 2024 term.

Goldman reviewed the “tricky question” of forum shopping, which is at the heart of case Royal Canin USA Inc. et al. v. Wullschleger et al. Consumers filed a class action lawsuit in state court for deceptive advertising. Royal Canin and Nestle Goldman successfully got the case move to federal court. The consumers amended their complaint to remove references to federal law and asked for the case to be remanded back to the state court.

A federal court “can’t keep a case it doesn’t have federal jurisdiction in,” Goldman said. “But at the same time, the policy and disfavored actions of forum shopping have to be taken into account.”
