Bracewell’s Scott Segal told Law360 that the US Department of Energy’s highly anticipated report on LNG should not be used in legal challenges to export approvals.
Segal explained that there are ample grounds to withdraw it, such as not adhering to decades-old Office of Management and Budget guidelines for dissemination of information by government agencies.
“OMB guidelines are designed to ensure and maximize the quality, objectivity, utility and integrity of information disseminated by federal agencies, including DOE,” Segal said. “In light of its biases, it is arguable that the report does not meet the standards contemplated by OMB.”
