SEATTLE – Bracewell LLP successfully defended Toshiba Corp., Toshiba America Electronic Components, Inc. and Toshiba America Business Solutions, Inc. against five US patent claims asserted by Monument Peak Ventures, LLC (MPV). The technologies at issue related to facial recognition algorithms, digital marketing, and the capture and manipulation of digital images.
On August 12, the US District Court Central District of California granted Bracewell’s motion, which argued that the patents were directed to unpatentable subject matter under 35 U.S.C. § 101, and dismissed MPV’s claims of willful infringement with prejudice. MPV voluntarily dismissed with prejudice the remaining patent-in-suit, which had not been subject to the motion.
