Following the Supreme Court’s rejection to stay the EPA’s power plant greenhouse gas rule while challenges proceed in a lower court, supporters and opponents alike are expressing optimism over their future litigation prospects.
Bracewell’s Jeff Holmstead told Inside EPA that “knowing that there are three justices who seem to believe the rule is probably unlawful means we have to feel optimistic” about a possible scenario in which critics appeal an adverse decision by the US Court of Appeals for the District of Columbia Circuit.
