About Damian

Damian is a high-stakes international arbitrator and litigator. His practice primarily accents energy, oil and gas, power, infrastructure, construction, utilities, natural resources, maritime and transport disputes. Damian also advises in relation to international trade, business and general commercial disputes. He has extensive experience as counsel in complex international arbitration disputes under the ICC, UNCITRAL, ICSID, SIAC, HKIAC, SCMA, GAFTA, CIETAC, DIFC and LCIA rules. 

Damian retains full Higher Rights of Audience before the English courts and has also worked in Hong Kong, Singapore, Sydney and Dubai on a diverse range of global disputes, many featuring multi-billion dollar claims. He frequently presents and publishes on international arbitration topics and has guest lectured at the University of Sydney.

Yemeni oil company — advised on claims against a Yemeni oil and gas company, regarding LNG supply and operation contracts on a new $4 billion 2-train LNG facility in Yemen. Yemeni law applied.*

North American EPC contractor — represented in claims against a major Australian oil and gas consortium, concerning a $5 billion upstream EPC contract for coal seam gas extraction as part of a new $19 billion 2-train LNG facility in Queensland, Australia. Queensland law applied.*

British oil and gas company — represented in dispute with a U.S. energy and resources company, concerning a farmout agreement for the exploration and exploitation of hydrocarbons onshore Colombia. English law applied.*

Italian oil and gas corporation — represented in dispute with a British gas transportation company, concerning an agreement for the pipeline transportation of natural gas and condensate from North Sea production fields to onshore England. English law applied.*

Saudi Arabian / North American JV chemical corporation — advised on claims brought by a Turkish EPC contractor on a propylene oxide plant project, forming part of a new $20 billion petrochemical complex in Saudi Arabia. English law applied.*

North American oil and gas corporation — advised on claims brought by a French onshore pipeline contractor on a new $16 billion LNG facility in Papua New Guinea. Papua New Guinean law applied.*

French EPC contractor — represented in SIAC arbitration proceedings against a British petrochemical JV company, concerning an EPC contract for a synthesis gas plant project forming part of a $3 billion integrated petrochemical site in China.  English substantive law and Singaporean procedural law applied.*

Greek EPC contractor — advised on appeal from an arbitral award, concerning claims against an Australian oil and gas company under an upstream EPC contract for 550km export pipeline and gas collection forming part of a new $25 billion 3-train LNG facility in Queensland. Queensland law applied.*

Saudi Arabian petrochemical company — advised on various issues concerning a $170 million polybutylene terephthalate plant project in Saudi Arabia. English law applied.*

North American oil and gas corporation — represented in claims brought by an Australian-Italian energy JV contractor on a LNG loading jetty and marine structures project, forming part of a new $55 billion 3-train LNG facility in Western Australia. Western Australian law applied.*

French power company — represented in ICC arbitration proceedings against a Russian engineering company, concerning the design of a step-up main transformer on a $650 million lignite-fired 330MV thermal power plant in Greece. Greek substantive and procedural law applied.*

Saudi Arabian EPC consortium — represented in relation to claims brought by a South Korean engineering contractor on a $3 billion 3100MW power and desalination plant in Saudi Arabia. English law applied.*

North American engineering company — represented in Supreme Court of New South Wales proceedings against an Australian main contractor, concerning a 6km rail infrastructure and associated stations, bridges and viaducts project in Sydney. New South Wales law applied.*

Saudi Arabian / North American JV chemical corporation — advised on claims brought by an Italian EPC contractor on a manufacturing plant project, forming part of a new $20 billion petrochemical project in Saudi Arabia. English law applied.*

South Korean EPC contractor — advised on claims against a major French energy corporation, concerning construction of a $1.5 billion 1600MW power and desalination plant in U.A.E. English law applied.*

Hong Kong construction contractor — represented in HKIAC arbitration proceedings against a Hong Kong property developer, concerning the construction of a residential development in Kowloon, Hong Kong. English substantive and Hong Kong procedural law applied.*

Singaporean offshore and marine company — represented in SCMA arbitration proceedings against the Singaporean subsidiary of a Norwegian energy company, concerning the refurbishment and upgrade of an offshore semi-submersible drilling rig in the Netherlands.  Singaporean substantive and procedural law applied.*

Papua New Guinean hotel developer — represented in dispute with a New Zealand construction contractor and a South-West Pacific engineering consultancy, concerning the construction of two major hotels in Papua New Guinea. Papua New Guinean law applied.*

Chinese telecoms manufacturer — advised on claims against a major Australian engineering company, concerning the design, construct and operation works for a new digital train radio system forming part of a new rail infrastructure project in New South Wales. New South Wales law applied.*
