The Supreme Court Will Hear Challenges to the EPA’s Climate Authority. Here’s What to Know.

Bracewell’s Jeff Holmstead told The Climate 202 that the Supreme Court agreeing to hear cases challenging the Environmental Protection Agency’s authority to limit greenhouse gas emissions from power plants as a potentially “very big deal.”

The Supreme Court said Oct. 29 that it would hear the cases in response to requests from Republican-led states and the coal industry.

Holmstead previously told The Washington Post, “As a practical matter, this will almost certainly prevent the Biden administration from moving forward with a new rule to regulate carbon emissions from the power sector. They’ll have to wait to see what the Supreme Court says about how (and whether) they can regulate carbon emissions from the power sector under current law.”
