Bracewell Wins $1.5 Million Judgment on Behalf of HTC Corporation

HOUSTON Bracewell LLP obtained a judgment and award of fees on behalf of consumer electronics company HTC Corporation in a trademark infringement case brought by Valador, Inc. in the Eastern District of Virginia.

The court concluded that Valador’s claims were objectively unreasonable and that the exceptional nature of the case justified an award of fees. The court granted HTC’s request for more than $1.5 million in attorneys’ fees and costs without reduction or objection.

The case was initially filed in 2016 and was assigned an accelerated trial date in March 2017. But on the eve of trial, Bracewell prevailed on summary judgment on all of Valador’s claims. The Fourth Circuit Court of Appeals subsequently affirmed that victory.
