Bracewell Represented Shell Energy North America (US), L.P. in FERC Settlement, Ending Nearly Two Decades of Litigation

WASHINGTON, DC – Bracewell LLP represented Shell Energy North America (US), L.P. (Shell Energy) in litigation and a settlement filed at the Federal Enforcement Regulatory Commission (FERC) over claims for refunds for short-term energy sales that Shell Energy made in the western U.S. markets during the 2000–2001 California energy crisis. 

The litigation, held before FERC and the Ninth Circuit Court of Appeals, involved multiple proceedings. The case was brought by utilities based in California, the California Public Utilities Commission, and the California Attorney General on multiple theories of liability.

The settlement agreement, filed for approval by FERC on October 19, 2017 and expected to be approved in 2018, brings to a close nearly two decades of litigation.
