Bracewell Assists Energy Transfer Company in Obtaining First Greenfield GHG Permit

Bracewell & Giuliani assisted Energy Transfer Company, a Texas-based midstream energy firm, in obtaining from the U.S. Environmental Protection Agency a new Clean Air Act Prevention of Significant Deterioration permit for greenhouse gas emissions from four proposed gas processing plants at a site in South Texas under EPA’s Tailoring Rule. This is the first greenhouse gas PSD permit obtained from EPA for a greenfield facility and only the second such permit EPA has issued. Further details on this permit and on EPA Region 6’s Greenhouse Gas Permitting program are here.
