In the last year, numerous federal agencies created new restrictions—and/or enhanced enforcement of existing ones—on employer-imposed secrecy obligations and privacy commitments. Agency restrictions not only invalidate "overly broad" confidentiality commitments but also result in fines and other penalties for merely maintaining the restrictions, even without invoking them against an employee.
